2. Service description
FitEnglish offers online English classes through a credit system.
Each credit equals one individual class, unless another format is expressly indicated. Credits are purchased via payment and allow classes to be booked within their applicable validity period.
Classes take place online through platforms such as Microsoft Teams, Google Meet or other equivalent tools.
FitEnglish may offer individual classes and dual or shared classes between two students with compatible level, goals and availability.
3. Registration and user account
To use the service, the user must create an account with their name and email address, either through manual registration or via Google.
The user is responsible for providing accurate information, keeping their credentials confidential and preventing any unauthorised use of their account.
FitEnglish is not liable for any damages or losses arising from the improper use of the account by the user or by third parties who have accessed it with their credentials.
4. Credits, prices and payments
Credits are purchased by card payment via Stripe or other payment methods enabled on the website.
Prices are shown in euros and include applicable taxes, unless otherwise indicated.
Credits are non-transferable, may not be assigned to third parties and cannot be exchanged for cash.
The validity of credits depends on the type of purchase made:
- Individual class: the credit expires 15 days from the date of purchase.
- Pack of 5 classes: the credits expire 2 months from the date of purchase.
- Pack of 10 classes: the credits expire 4 months from the date of purchase.
Once the validity period has ended, unused credits will expire automatically and may no longer be used for new bookings.
For dual or shared classes, FitEnglish may apply a specific credit system, discount or proportional adjustment, which will be indicated before the class is contracted or booked.
5. Class bookings
Classes must be booked through the system enabled on the website or by the means indicated by FitEnglish.
Bookings are subject to schedule availability.
The user is responsible for booking their classes within the validity period of their credits.
FitEnglish may modify or reject a booking when there is an availability problem, technical error, calendar incident or justified cause.
For dual or shared classes, the booking is subject to the availability and confirmation of both students and of FitEnglish.
Contracting or requesting a dual class does not guarantee the permanent availability of another compatible student. If it is not possible to form or maintain a dual class, FitEnglish may propose alternative time slots, an individual class with the corresponding credit adjustment or the refund of the unused credit, as appropriate.
6. Cancellations and schedule changes
For individual classes, the user may request the cancellation or modification of a class at least 24 hours in advance.
If an individual class is cancelled at least 24 hours in advance and confirmed by FitEnglish, the credit will be returned to the user's account so it can be used for a new booking within its validity period.
If the user cancels an individual class less than 24 hours in advance, does not attend the class or does not connect at the booked time, the credit may be considered used.
For dual or shared classes, cancellation or modification by the student must be requested at least 72 hours in advance, due to the coordination required with another student.
If the student cancels a dual class less than 72 hours in advance, does not attend or does not connect at the booked time, the corresponding credit may be considered used.
On an exceptional basis, FitEnglish may assess serious situations or justified causes, such as illness, family emergency or other circumstances of force majeure, and offer a new booking or the refund of the credit, as appropriate.
If FitEnglish cancels a class for a cause attributable to the teacher, the user may choose between recovering the credit or booking a new class in another available time slot.
If a dual class cannot take place for a cause attributable to FitEnglish or due to the unavailability of the other student, FitEnglish will offer the affected student a new booking, the refund of the credit or the possibility of taking an individual class by adjusting the corresponding credits, as appropriate.
7. Lateness
If the user is late to a class, the class will end at the originally scheduled time and will not be extended automatically.
If the delay is attributable to FitEnglish, the lost time will be compensated, a new booking will be offered or the corresponding credit will be refunded, as appropriate.
8. Technical problems
The user is responsible for having an adequate internet connection, a compatible device, camera, microphone and correct access to the platform used for the class.
If the class cannot take place or is seriously affected by technical problems attributable to the user, the credit may be considered used.
If the technical incident is attributable to FitEnglish, a new booking will be offered or the corresponding credit will be refunded.
9. Refund policy and right of withdrawal
Unused credits will not be refundable once the legal withdrawal period has elapsed, except in the case of an error attributable to FitEnglish, cancellation by FitEnglish or a justified cause expressly accepted by FitEnglish.
For purchases made online, the consumer user may exercise their right of withdrawal within the legal period of 14 calendar days from the date of purchase, provided they have not fully or partially used the credits acquired.
If the user expressly requests to start the service before the legal withdrawal period ends and uses one or more credits, the amount corresponding to the services already provided may not be refundable.

10. Acceptable use of the service
The user agrees to make correct use of the service, respect booked schedules, not share their account with third parties and maintain respectful communication during classes.
FitEnglish may suspend or cancel access to the service in the event of improper use, disrespectful behaviour, non-payment, unauthorised transfer of the account or serious breach of these terms.
11. Minors
In the case of students who are minors, the contracting of the service and the acceptance of these terms must be carried out by their mother, father, guardian or legal representative.
The responsible adult will be the one who manages the purchase, bookings, communications and any request related to the service.
12. Recording of classes
Classes may not be recorded by the user without the prior and express authorisation of FitEnglish.
If FitEnglish proposes recording a class for educational, follow-up or review purposes, the corresponding consent will be requested before the recording is made.
13. Materials and intellectual property
The materials provided by FitEnglish during classes are for the student's personal and educational use.
Their reproduction, distribution, publication, sale or transfer to third parties without the prior and express authorisation of FitEnglish is not permitted.
14. Communications
FitEnglish may contact the user by email or other means provided by the user to manage bookings, payments, incidents, schedule changes, service updates or communications related to these terms.
The user is responsible for keeping their contact details up to date.
15. Changes to the terms
FitEnglish reserves the right to modify these Terms of Service when necessary for legal, technical, organisational or commercial reasons.
When the changes are relevant, FitEnglish will inform the user at least 15 days in advance by email or a visible notice on the website.
The applicable terms will be those in force at the time of purchase, unless a subsequent modification is required by legal obligation.
16. Data protection
The processing of the user's personal data will be governed by the Privacy Policy available on the website.
The user must read and accept the Privacy Policy before using the service or making a purchase.
17. Applicable law and dispute resolution
These terms are governed by Spanish law.
Before initiating any formal claim, the parties will try to resolve any incident in good faith through email communication.
For any dispute, the parties will submit to the courts and tribunals that apply under the regulations in force on consumers and users.
